1. Introduction

The Toggery (“we,” “us,” or “our”) operates the physical store in Bishop, California and the website at https://toggerybishop.com (the “Site”). We respect your privacy and handle your personal information in accordance with applicable law, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), and comparable state privacy laws.

This Privacy and Cookie Policy explains what we collect, how we use and share it, the cookies and tracking technologies we use, and the rights and choices available to you. By using the Site, you acknowledge that you have read this policy.

2. Information We Collect

We collect the following categories of personal information, depending on how you interact with us.

Information you provide directly

  • Identifiers — name, billing and shipping address, email address, phone number, and account login credentials.
  • Commercial information — products you purchase, view, or return; order history; and customer service interactions.
  • Communications — messages you send through forms, email, phone, or our newsletter sign-up.

Information collected automatically when you use the Site

  • Internet and device activity — IP address, browser and device type, device identifiers, pages viewed, links clicked, referring site, and how you navigate the Site, collected through cookies and similar technologies (see Section 6).
  • Approximate geolocation — general location (such as city or region) inferred from your IP address.

Payment information

Payment card details are collected and processed by our third-party payment processor. We do not store full card numbers on our systems.

Information from third parties

We may receive information from analytics and advertising partners (such as Google and Meta) and from social media platforms when you interact with our pages or ads.

We do not intentionally collect sensitive personal information through the Site. If you provide such information voluntarily, we use it only as needed to respond to you.

3. How We Use Your Information

We use personal information to:

  • Process, fulfill, and deliver your orders, and manage returns and exchanges;
  • Create and maintain your account;
  • Respond to your questions and provide customer support;
  • Send newsletters, promotions, and offers (you can opt out at any time);
  • Understand how visitors use the Site and improve our products, services, and marketing;
  • Measure and target advertising, including on social media platforms; and
  • Detect and prevent fraud, secure the Site, and comply with our legal obligations.

4. How We Share Your Information

We share personal information with:

  • Service providers acting on our behalf — hosting, payment processing, shipping, email delivery, and customer support providers.
  • Analytics and advertising partners — including Google and Meta (Facebook/Instagram), and other social media platforms — to measure Site traffic and to deliver and measure advertising.
  • Legal and safety recipients — when required by law, to enforce our terms, or to protect our rights, customers, or the public.
  • Business transfers — in connection with a merger, acquisition, or sale of assets.

We do not sell your personal information for money. However, our use of analytics and advertising cookies and pixels may be considered “selling” or “sharing” of personal information for cross-context behavioral advertising under the CCPA. You can opt out — see Section 7 and the “Do Not Sell or Share My Personal Information” / “Your Privacy Choices” control.

5. How We Protect Your Information

We maintain reasonable physical, electronic, and administrative safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

6. Cookies and Tracking Technologies

What cookies are

A cookie is a small text file stored on your device when you visit a website. Cookies and similar technologies (pixels, tags, and SDKs) help the Site function, remember preferences, analyze traffic, and support advertising.

Your choices and our consent banner

When you first visit the Site, a cookie consent banner lets you accept, reject, or customize non-essential cookies. Strictly necessary cookies are always active because the Site cannot function without them; all other categories remain off until you affirmatively opt in. You can change your choices any time through the “Cookie Settings” control and through your browser settings. We honor recognized opt-out preference signals, including Global Privacy Control (GPC), as required by California law.

Categories of cookies we use

Strictly necessary — required to operate the Site (shopping cart, checkout, security, caching). Set by our Magento platform; cannot be switched off.

Analytics — Google Analytics (GA4) helps us understand how visitors use the Site.

Advertising and social media — the Meta (Facebook/Instagram) Pixel and other social media tools help us measure and target advertising.

Functional — remember preferences such as selected store view or language.

7. Your California Privacy Rights (CCPA)

If you are a California resident, you have the right to:

  • Know / access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties to whom we disclosed it;
  • Delete personal information we collected from you, subject to legal exceptions;
  • Correct inaccurate personal information;
  • Opt out of the sale or sharing of your personal information for cross-context behavioral advertising;
  • Limit the use of sensitive personal information, to the extent we use any; and

  • Online: our Contact Us form
  • Phone: (760) 872-3211
  • Mail: 115 N Main St., Bishop, CA 93514

We may need to verify your identity before fulfilling it. You may use an authorized agent to submit a request on your behalf with proper authorization.

8. Privacy Rights for Other U.S. State Residents

If you reside in another state with a comprehensive consumer privacy law — including Oregon, Texas, Colorado, Connecticut, Virginia, Utah, and others — you may have rights to access, correct, delete, and obtain a portable copy of your personal information, and to opt out of targeted advertising, the sale of personal data, and certain profiling. Contact us using the methods in Section 7, and we will respond as required by your state’s law.

9. Data Retention

We keep personal information only as long as needed for the purposes described in this policy. In general, we retain account information for as long as your account remains active; order and purchase records for the period needed to support returns and to meet our legal, tax, and accounting obligations; and marketing contact information until you unsubscribe or ask us to delete it. When information is no longer needed, we delete or de-identify it. Specific retention periods vary by data type and legal requirement.

10. Children’s Privacy

The Site is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. Consistent with the CCPA, we also do not knowingly sell or share the personal information of consumers under 16 years of age without the affirmative authorization required by law. If you believe a child has provided us information, please contact us and we will delete it.

11. Links to Other Websites

The Site may contain links to third-party websites, including our social media pages. We are not responsible for the privacy practices of sites we do not operate. Please review the privacy policy of any website you visit.

12. Changes to This Policy

We may update this Privacy and Cookie Policy from time to time. When we do, we will revise the “Last Updated” date above and, where appropriate, provide additional notice.
